# b3Player Pro — End User License Agreement (EULA)

**Effective date:** 2026-10-26 · **Version of these terms:** EULA-EN 1.0

**Licensor and rights holder:** Benjamin Mauz, operating under the b3LAB brand, Ruländerstr. 3, 73733 Esslingen am Neckar,
Germany, contact@b3lab.io (“Licensor”).

**Product:** b3Player Pro, version 1.0.13 and later of the 1.x series, including the accompanying documentation (“Software”).

This EULA exists in English (this file) and in German (`LICENSE_DE.md`). Both versions have the same meaning.

---

## 1. Scope and relationship to the purchase

1. This EULA governs the use rights granted by Licensor in the Software, to the extent validly accepted or otherwise agreed.
2. The sales contract is concluded with the seller of the purchase channel, for the sale through Gumroad with Gumroad as merchant of
record and reseller, not with Licensor. Nothing in this EULA removes mandatory legal rights against the seller or any other
responsible party. Statutory rights of withdrawal and refund are governed by the purchase contract and the information given at
   checkout.
3. Individually agreed terms and applicable mandatory law prevail in the event of conflict.
4. Third-party components remain subject to their own licenses, which prevail for those components where their rights require it
(section 5). Their notices are in `ThirdPartyNotices.md` (in the Software: Help ▸ Third-Party Notices; also in the disk image).

## 2. License grant

1. Subject to a lawful entitlement, Licensor grants the licensee a non-exclusive right to use the Software within the scope of
the purchased license, without a fixed end date (perpetual license).
2. A single named-user license permits one natural person to install the Software on up to **two personally controlled Macs**,
provided it is not used by several persons under one license. Additional users require additional licenses.
3. Commercial client projects, live productions, playback, renders and other lawful professional output are permitted. Licensor
does not claim ownership of the licensee's own output merely because the Software was used.
4. Updates of the 1.x series are included. A perpetual license does not, by itself, entitle the licensee to every future paid
feature upgrade or to a new major version (2.x). Mandatory updates, security and conformity obligations under applicable law
   remain unaffected.
5. **Demo Mode.** Without a license key the Software runs in Demo Mode: the viewer in the player window runs at full frame rate
   and shows a demo banner; the outputs (SDI/DeckLink, NDI®, Syphon) are limited to 2 frames per second and carry the banner;
inputs can be used. A valid license key unlocks the full function.

## 3. License activation and availability

1. Before the first contact with the license server, the Software shows this EULA and the privacy notice and asks for their
acceptance; without it, the Software does not contact the license server. The Software validates the license key with a
license server when it is activated, at later checks and when it is deactivated. Any collection or processing of personal data
is governed by the privacy notice and applicable data protection law (section 10).
2. Activation needs an internet connection once. After a successful check the Software works offline for up to 30 days; then it
needs a new successful check. This is also shown in the license window (App ▸ License…).
3. Licensor will implement reasonable measures required by contract or law to keep lawful use possible when the activation
infrastructure is unavailable. Deactivation or revocation of a license needs a valid legal and contractual basis.

## 4. Permitted and restricted activities

1. The licensee may run the Software for its intended purpose, make backup copies and perform other acts where applicable law
   permits them.
2. Subject to mandatory law and applicable third-party licenses, unauthorized redistribution as a standalone product, unauthorized
sublicensing, infringement of intellectual property rights and other unauthorized exploitation are prohibited. The licensee
is responsible for holding the rights to the media played, processed and sent with the Software.
3. Nothing in this EULA restricts mandatory rights to observe, test, analyze, reverse engineer, decompile, fix errors or achieve
interoperability where such rights exist under applicable law. The rights under section 5.3 (LGPL) remain unaffected. Section
5.2 contains the restrictions that the NDI license requires for the NDI library.
4. Lawful transfer or resale of certain perpetual software licenses remains subject to statutory exhaustion and other mandatory
rules; this EULA does not impose an absolute prohibition on such transfers. To transfer a license, the licensee deactivates the
Software on the old Macs (“Reset License”) and tells Licensor by email, so that the license key can be assigned to the new owner.
5. The licensee may not use the license key beyond section 2, may not rent, lease or lend the Software and may not offer it
to third parties as a service.
6. The licensee may not export or re-export the Software in violation of applicable export laws, including those of the
   United States.

## 5. Ownership, third-party components and trademarks

1. **Ownership.** Rights in Licensor's original Software remain with the relevant rights holders. Purchase or use of the
Software does not transfer ownership of the underlying intellectual property. The Software contains third-party
components that are described in this section 5 and in `ThirdPartyNotices.md`. **Licensor does not claim ownership of
FFmpeg**; its rights holders are named in its project history (https://git.ffmpeg.org/ffmpeg).
2. **NDI®.** The Software includes the NDI® runtime library (`libndi`), © Vizrt NDI AB, which Licensor uses under the NDI SDK
License Agreement. To the extent permitted by applicable law the licensee may not (i) modify the NDI library or any part
of it, (ii) reverse engineer, disassemble or recompile the NDI library, NDI products or any protocols they use, whether
transmitted or received over a network or used inside the computer, or attempt to do so, (iii) circumvent any technical
limitation in them, or (iv) remove, obscure or alter any proprietary notices or labels on or within them. NDI and its
licensors disclaim all warranties and, to the extent permitted by law, all liability for damages of any kind, whether
direct, indirect, incidental or consequential, arising from the use of the Software. The licensee must comply with all
applicable export laws and regulations, including those of the United States. NDI Copyright (C) 2023-2026 Vizrt NDI AB. NDI®
is a registered trademark of Vizrt NDI AB. https://ndi.video/ If the Software is used to develop products that use NDI,
those products must comply with the NDI SDK License Agreement and carry the terms of this section 5.2 in their own license
   agreement.
3. **FFmpeg (LGPL).** The Software uses libraries from the FFmpeg project (https://ffmpeg.org/) under the GNU Lesser General
Public License, version 2.1 or later. The libraries are not modified and are included as shared libraries in the application
(`Contents/Frameworks`); the licensee may replace them with an interface-compatible build (see
`LICENSES/FFmpeg-REPLACE.md`). Source code, build script and configure line: https://b3lab.io/ffmpeg-source/b3playerpro/.
Nothing in this EULA restricts the licensee's rights under the LGPL. In particular, no restriction on modifying or reverse
engineering applies to the FFmpeg libraries or to what is necessary to debug the licensee's own modifications of them. This
does not extend to the NDI library or to other parts of the Software.
4. **Syphon and FFGL.** The Syphon Framework and the FFGL SDK headers are licensed under BSD 3-Clause licenses; their texts are in
   `ThirdPartyNotices.md`.
5. **Blackmagic Design DeckLink.** SDI input and output through DeckLink devices use header files and dispatch code of the
Blackmagic Design DeckLink SDK. The Desktop Video driver is installed by the licensee. The Software is compatible with
Blackmagic Design DeckLink hardware; it is not affiliated with or endorsed by Blackmagic Design.
6. **Plug-ins, drivers and devices of third parties.** FFGL effect plug-ins, drivers (such as Blackmagic Desktop Video), NDI
sources and receivers and connected hardware are not part of the Software and are used under their own terms.
7. **Trademarks.** NDI® is a registered trademark of Vizrt NDI AB. DeckLink and Blackmagic Design are trademarks of Blackmagic
Design Pty. Ltd. Apple, macOS, Metal, ProRes, QuickTime and VideoToolbox are trademarks of Apple Inc. FFmpeg is a trademark of
Fabrice Bellard. Mitti, Resolume, Resolume Arena, DaVinci Resolve, Syphon, HAP and all other names belong to their
respective owners and are used only to describe compatibility. References to host applications or third-party names do not
   imply endorsement, certification or affiliation.

## 6. Functionality, compatibility and updates

1. The contractual functionality, system requirements (macOS 14 or later on Apple silicon), supported devices and known
restrictions are specified in the product description on the product page at https://b3lab.gumroad.com/l/b3playerpro at the time of
purchase, in the user guide shipped with the Software (`b3player-help.html`, section “Known Limitations”) and in any individual
   contract.
2. Licensor provides updates to the extent required by the contract or applicable law, including applicable security and
   conformity updates.
3. Optional feature upgrades, new major versions and extra paid services may be offered separately. Statutory remedies and
   update claims remain.
4. Materially adverse changes to continuously supplied digital products are subject to applicable statutory safeguards.
5. **Formats, codecs and content.** The Software plays and exports formats such as H.264/AVC, HEVC, MPEG-4, ProRes and AAC with
components of macOS (VideoToolbox, AudioToolbox, AVFoundation); further formats are decoded by the FFmpeg libraries of
section 5.3. The use of such formats, in particular the commercial distribution or broadcast of encoded content, may require
licenses from patent pools or rights holders (for AVC/HEVC, for example, Via LA and Access Advance). The licensee is
responsible for obtaining the licenses needed for the licensee's own use. Licensor does not warrant that the use is licensed
   for commercial purposes.

## 7. Documentation, support and live use

1. Documentation and support are provided according to the purchase description and any separately agreed support terms.
Unless expressly agreed, no round-the-clock helpdesk or guaranteed compatibility with undocumented future operating
systems or devices is promised. Existing contractual obligations and mandatory consumer remedies remain unaffected.
2. The Software is used at events and in broadcast. The licensee should rehearse, keep a backup playback system and back up
data, and test the setup, including devices and drivers, before every show. This does not limit mandatory rights.

## 8. Consumer remedies, warranties and liability

1. All non-excludable statutory remedies, conformity and update rights remain fully available. Nothing in this EULA limits such
   rights of consumers.
2. Liability is unlimited for intent, gross negligence, injury to life, body or health, under mandatory product liability law and
   for express guarantees.
3. Otherwise, the statutory provisions on liability apply. There is no blanket “AS IS / no warranty / no liability” waiver of
   consumer rights.

## 9. Term and termination

1. A perpetual license continues within its agreed scope unless lawfully terminated. If the purchase is cancelled, withdrawn or
refunded, the license ends with it.
2. Mandatory cancellation, termination and withdrawal rights remain unaffected. Licensor may terminate for good cause. Where
appropriate and legally required, Licensor first gives the licensee a reasonable opportunity to remedy a material breach,
for example sharing a license key or defeating the license check.
3. Termination does not automatically remove legal rights relating to the licensee's own data or mandatory remedies. Rights
that third-party licenses give the licensee, in particular under the LGPL, are not affected.

## 10. Privacy and security

1. The Software collects no telemetry, analytics or usage data. The only data it sends to Licensor is that of the license check
(license key, a device identifier and the version of the Software), as described in the privacy notice (`PRIVACY.md`, linked in the
license window and included in the disk image). Network features that the licensee switches on (NDI, OSC) work with the
   licensee's own network.
2. Security issues may be reported to contact@b3lab.io; Licensor operates an appropriate process for handling vulnerabilities.

## 11. Governing law and consumer protections

1. German law governs this license agreement to the extent a valid choice of law is possible. Where the applicable
conflict-of-laws rules preserve mandatory protections of a consumer's country of habitual residence, those protections are
   not excluded.
2. No exclusive forum is agreed.

## 12. Contact and version history
